Death, biohazard, and meth contamination disclosure rules for Washington real estate and rentals — for sellers, buyers, and landlords.
Washington Form 17 seller disclosure covers physical condition only. Deaths, crimes, and other stigma events are not material facts under Washington law.
Statute: Wash. Rev. Code § 64.06
Remedy standard: Form 17 seller disclosure statement. Stigma-only claims are generally barred in Washington, but sellers must answer truthfully if asked in writing — lies in response to a direct question are actionable fraud in every state.
Death disclosure to tenants: Not required. Biohazard/meth disclosure: Required as a habitability matter. Bedbug disclosure: Not required by state law. Federal lead paint disclosure applies to pre-1978 housing in all states.
Washington has comprehensive meth cleanup law — contaminated properties are posted by local health officers and must be decontaminated to 1.5 µg/100 cm² (raised from 0.1 in 2015) by certified contractors.
